OPINION

EATON, Judge: This matter is before the court following remand to the United States International Trade Commission ("ITC"). In Committee for Fair Coke Trade v. United States, 27 CIT __, slip op. 03-56 (May 20, 2003) ("CFCT I"), the court remanded the ITC's negative preliminary injury determination1 concerning blast furnace coke2 from China and Japan, specifically with respect to its attenuated competition finding. See Blast Furnace Coke from China and Japan, USITC Pub. 3444, Inv. Nos. 731-TA-951-952 (Aug. 2001), List 2, Doc. 53 ("Preliminary Determination"). On remand, the ITC expressed its views in Blast Furnace Coke from China and Japan, USITC

Jurisdiction lies pursuant to 28 U.S.C. § 1581(c) (2000) and 19 U.S.C. § 1516a(a)(1)(C) (2000). For the reasons discussed below, plaintiffs Committee for Fair Coke Trade and United Steelworkers of America, AFLCIO/CLC's ("Plaintiffs") Motion for Judgment Upon the Agency Record is denied and the Preliminary Determination, as modified on remand, is sustained.

BACKGROUND

In response to a petition filed by Plaintiffs, the ITC instituted antidumping investigations of imports of blast furnace coke from China and Japan in June 2001.3 See Blast Furnace Coke From China and Japan, 66 Fed.
