The Supreme Court, Special Term, New York County, Sidney A. Fine, J., 43 Misc.2d 816, 252 N.Y.S.2d 502, in the first action entered an order granting a motion of the plaintiffs for summary judgment and held that the State Minimum Wage Act, Labor Law, Consol.Laws, c. 31, § 652, authorizing the Industrial Commission to establish different minimum wage rate for different localities in respect to particular industries was a 'general law' and not a 'special law' within constitutional provision prohibiting local laws inconsistent with any general law, and therefore Local Law 1964, No. 45, fixing higher minimum wage rate than State Minimum Wage Act, was unconstitutional. The City of New York appealed.

The Appellate Division, 22 A.D.2d 762, 252 N.Y.S.2d 955, 956, unanimously affirmed the orders without opinion.

The City of New York appealed to the Court of Appeals.
