Appeal from court of common pleas, Philadelphia county.

Petition by Simon Strouse. trading as S. Strouse & Co., for the payment into court of the proceeds of a sale under an execution issued upon a judgment for Henry J. Braker against Beverly English and another, trading as B. English & Sons, and for a feigned issue to test the validity of the judgment. From a judgment discharging the rule to show cause against the making of the payment and the award of the issue, the petitioner appeals. Affirmed.
