ORDER

On order of the Court, the delayed application for leave to appeal is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Bay Circuit Court for the successor of the late Judge Theiler to conduct a new evidentiary hearing regarding defendant's claims of ineffective assistance of trial counsel and to make findings of fact and conclusions of law within 90 days of this order. The defendant must promptly request that a transcript of the proceedings on remand be prepared and transmitted to this Court. The defendant shall thereafter file a supplemental brief in support of the delayed application addressing matters considered at the evidentiary hearing within 28 days after the transcript is filed with this Court, and the prosecutor shall thereafter file a supplemental brief in response within 28 days after the filing of the defendant's supplemental brief.

We retain jurisdiction.
