940 St. Nicholas Ave. Corp. v. Grant
Decision Date | 21 June 1962 |
Parties | 940 ST. NICHOLAS AVENUE CORP., Landlord-Appellant, v. James GRANT, Tenant-Respondent. |
Court | New York Supreme Court — Appellate Term |
Donald Crichton, New York City, Louis J. Shaw, New York City, of counsel, for appellant. Mortimer Getzels (Legal Aid Society), Abraham Eckstein, and Ciceil L. Gross, of counsel, for respondent.
Before HECHT, J. P., and HOFSTADTER and TILZER, JJ.
The record clearly establishes that tenant's conduct in repeatedly failing and refusing to pay his rent when due was a calculated scheme to harass landlord. The necessity of instituting 17 separate summary proceedings during a 24 month period warranted a final order in favor of landlord, as prayed for in its petition (Zalaznick v. Imbembo, 35 Misc.2d 164, 232 N.Y.S.2d 442; Stern v. Carroll, 28 Misc.2d 507, 219 N.Y.S.2d 820; Taylor, Inc. v. Teller, 28 Misc.2d 508, 208 N.Y.S.2d 142).
Final order in favor of tenant is reversed, with $30 costs and final order directed in favor of landlord, as prayed for in the petition, with costs.
All concur.
