SIMPSON, J.

According to the statute (Acts 1890-91, p. 915) the terms of the criminal court of Jefferson county are held on the first Mondays in January, April, and September. The trial of this case was on December 9, 1903, and the paper purporting to be a bill of exceptions was signed on May 9, 1904. While there were agreements of counsel extending the time beyond this date, yet this was after the beginning of the next succeeding term of said court. Under the decisions of this court the bill of exceptions cannot be considered. Abercrombie & Williams v. Vandiver (Ala.) 37 So. 296; Cooley v. U.S. Savings & Loan Association, 132 Ala. 590, 31 So. 521; Birmingham Ry. & Electric Co. v. James, 138 Ala. 594, 36 So. 464.

There is no error in the record, and the judgment of the court is affirmed.
