This matter was tried before the court on January 15, 2020.
This matter involves an automobile accident which took place on April 23, 2016, in Waterbury, Connecticut. On said date at approximately 5:49 a.m., plaintiff, Emira Adzovski, was traveling southbound on Route 73 Highway at its intersection with Aurora Street. The plaintiff was stopped at said intersection for a red light. The defendant, Tefta Kreka, was traveling behind the plaintiff’s vehicle and failed to stop rear ending the plaintiff’s vehicle. The defendant has admitted liability. There is also an appearance by the plaintiff’s underinsured motorist carrier, Hanover Insurance who is not contesting liability.
As a result of the collision, the plaintiff claims that her body lurched forward while still seat belted. The plaintiff testified that her mouth struck the steering wheel. The court has reviewed the photographs of the damage to the plaintiff’s vehicle and concludes that there was perceivable damage to the plaintiff’s vehicle. The police investigated the accident. The plaintiff refused medical attention at the scene. The plaintiff left the scene of the accident and returned home. Upon arriving at home the plaintiff began to experience neck and back pain. As a result, she went to St Mary’s Hospital emergency room to be evaluated. The evaluation by the emergency room on the date of the accident was that the plaintiff had suffered strains to her lower back and thoracic area. She was prescribed Flexeril for the pain and advised to follow up with her primary care physician if her pain persisted. On the same day the plaintiff also saw her dentist, at Middlebury Dental Center, due to the pain she was experiencing to her mouth after having struck the steering wheel. The dentist evaluated no broken teeth and inflammation to the gums which led to a prescription for antibiotics.
On April 25, 2016, the plaintiff returned to St. Mary’s Hospital emergency room with complaints of neck pain, headaches dizziness and nausea. The follow-up evaluation was neck strain and she was discharged to follow up with a physical therapist/chiropractor. On April 26, 2016, the plaintiff began a course of treatment with Dr. Rosa, a chiropractor. The plaintiff treated previously with Dr. Rosa for an automobile accident in 2013. Dr. Rosa’s diagnosis at the initial evaluation was that the plaintiff had suffered a cervical strain/sprain and lumbar strain/sprain.
