Appeal from St. Louis Circuit Court; J. Hugo Grimm, Judge.

Action by the American Manufacturing Company against the City of St. Louis. From a judgment for defendant, plaintiff appeals. Affirmed. See, also, 192 S. W. 399; 270 Mo. 40, 192 S. W. 402.

This is the second appeal of this cause to this court. The first was decided January 29, 1917, not yet officially reported, and by agreement of parties the cause is again submitted on the briefs filed on the former appeal. 270 Mo. 40, 192 S. W. 402. The rulings announced by this court on the former appeal are adhered to, and they are controlling in this, and for the reasons there stated the judgment is affirmed. All concur.
