Upon remand to this court by the Supreme Court of Alabama (366 So.2d 1125) it is considered that this cause should be reversed and remanded to the Circuit Court of Jefferson County, Bessemer Division, for entry of a judgment not inconsistent with the opinion of the Supreme Court of Alabama rendered in this matter on January 5, 1979.

REVERSED AND REMANDED.
