ORDER

On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the order of the Court of Appeals certified March 20, 1986 granting the motion to dismiss and REMAND this case to the Court of Appeals for consideration of the merits. This case is not moot. Appellants remain bound by a continuing order of the circuit court declaring their legal rights. East Grand Rapids School District v. Kent County Tax Allocation Board, 415 Mich. 381, 390, 330 N.W.2d 7 (1982); McMullen v. Secretary of State, 339 Mich. 175, 63 N.W.2d 599 (1954). See also, Swinehart v. Secretary of State, 27 Mich.App. 318, 183 N.W.2d 397 (1970), 1v. den. 384 Mich. 801 (1971); Schumacher v. Tidswell, 138 Mich.App. 708, 360 N.W.2d 915 (1984); and Plumbers and Pipefitters Local Union No. 190 v. Wolff, 141 Mich.App. 815, 369 N.W.2d 237 (1985).

We do not retain jurisdiction.
