Department of Health v. Owens-Corning Fiberglas Corp., OWENS-CORNING
Decision Date | 03 February 1969 |
Docket Number | OWENS-CORNING,No. A--61,A--61 |
Parties | DEPARTMENT OF HEALTH, State of New Jersey, Plaintiff-Respondent, v.FIBREGLAS CORPORATION, Defendant-Appellant. |
Court | New Jersey Supreme Court |
James Hunter, III, Camden, for appellant (Archer, Greiner, Hunter & Read, Camden, attorneys, Charles Lee Harp, Jr., Camden, on the brief).
Joseph A. Hoffman, First Asst. Atty. Gen., for respondent (Arthur J. Sills, Atty. Gen., attorney, Stephen Skillman, Deputy Atty. Gen., on the brief).
Subsequent to the entry of the orders appealed from, the defendant brought itself into sufficient compliance. Despite this, the plaintiff presses its contention that the orders were valid when made and were properly upheld in the Appellate Division, and that the defendant's appeal should therefore now be rejected. We agree and affirm for the reasons expressed by Judge Goldmann in his comprehensive opinion for the Appellate Division, reported at 100 N.J.Super. 366, 242 A.2d 21 (App.Div.1968).
Affirmed.
For affirmance: Chief Justice WEINTRAUB and Justices JACOBS, FRANCIS, HALL and SCHETTINO--5.
For reversal: None.
