PartiesDIMLER v. CALDWELL et al.
Decision Date05 March 1917
CourtUnited States State Supreme Court (New Jersey)

Appeal from Court of Chancery.

Suit by John Dimler against Caroline Caldwell and others. From the decree, complainant appeals. Affirmed.

William R. Wilson, of Elizabeth, for appellant. Sidney W. Eldridge, of Elizabeth, and Louis A. Ziegler, of Newark, for appellees.

PER CURIAM. So far as concerns the title to the property, we agree with Vice Chancellor Emery and the Chancellor. So far as the decree adjudges that the complainant is entitled to a lien for $750 and interest, we have assumed its correctness, since there is no appeal by the defendants from that part of the decree, and the complainant is not aggrieved thereby.

The decree is affirmed, with costs.
