McCLELLAN, J.

This appeal re-presents the questions presented in the first action by and against the same parties, decided in Dinkins v. Latham, 154 Ala. 90, 45 So. 60. A careful reconsideration of the premises does not convince that the previous decision is erroneous. The judgment is affirmed.

All the Justices concur.
