Foster v. Noyes

Decision Date25 April 1882
Citation12 N.W. 221,48 Mich. 273
CourtMichigan Supreme Court
PartiesFOSTER v. NOYES.

A judgment rendered by a justice cannot be garnished.

Error to Washtenaw.

Sawyer & Knowlton, for plaintiff in error.

E.D. Kinne, for defendant in error.

MARSTON, J.

We need not critically examine the several provisions of the statute relating to garnishee proceedings in justice court, as we are clearly of opinion that the reason advanced in Seivers v. Woodburn, 43 Mich. 275, against garnishing a judgment rendered by a justice, is equally applicable here.

The judgment must be affirmed with costs.

COOLEY and CAMPBELL, JJ., concurred.

GRAVES, C.J., did not sit in this case.
