Plaintiff in error brought this action in the circuit court of the United States for the district of Maryland against the defendant in error, 'a corporation duly incorporated under the laws of Maryland, for money payable by the defendant to the plaintiff,' as stated in the 'bill of particulars of plaintiff's claim,' and a trial was had upon the general issue pleaded, resulting in verdict and judgment for the defendant, May 14, 1885.From the bill of exceptions it appears that——
'At the trial of this case, the incorporation of the defendant being admitted the plaintiff, to maintain the issues upon his part joined, gave in evidence the agreement following between said defendant and the Equitable Gas-Light Company of Baltimore City, a Maryland corporation,—that is to say:
'[Duly signed and sealed October 7th, 1884.]
