Appeal from the Supreme Court, Appellate Division, Second Department, 36 A.D.2d 853, 321 N.Y.S.2d 452.
The Supreme Court, Kings County, granted separation to the wife and the husband appealed.
The Appellate Division modified the judgment by reducing the award of alimony of $75 a week to $25 a week and, as modified, affirmed. It held that in view of fact that parties lived together less than two years, that there was no issue, that the wife had previously been married three times and that prior to her marriage to the plaintiff husband had supported herself and had at least $8,000 in bank accounts and appeared to be capable of supporting herself, original award of alimony to be paid by 61-year-old husband dependent upon salary for livelihood was excessive. The wife appealed.
Order affirmed, without costs.
