ORDER AFFIRMING ORDER FOR SUMMARY JUDGMENT

This matter having come before the Court for Oral Argument on this day.AppellantRoleen Hargrove appeared personally and through counsel, Harold Chesnin.Gold Eagle Gaming Inc. appeared through counsel, John Sullivan.

Appellant made a preliminary motion for a continuance of the oral argument.After hearing arguments, the Panel denied the Motion for Continuance and proceeded with oral arguments.

After review of the record, oral arguments and deliberation , the Panel makes the following decision:

1.The Puyallup Tribal Court issued a Summary Judgment on August 31 1999.

2.Testimony and evidence show that there were no facts in dispute at the time of the signing.

3.It is in the discretion of the trial judge to decide if a matter should go forward for a hearing or may be disposed of by summary judgment.

4.We determine that the trial judge did not err in signing the summary judgment.
