ORDER OF DISMISSAL

Claimant requested review of Administrative Law Judge (ALJ) Bethlahmy's order that: (1) upheld the self-insured employer's denial of claimant's new/omitted medical condition claim for cervical conditions, headaches, and bilateral shoulder conditions; (2) dismissed claimant's appeal of an alleged de facto denial with prejudice; (3) denied claimant's challenge to a Notice of Acceptance and related penalties and attorney fees; and (4) affirmed the employer's "ceases" denial. The parties have submitted a proposed "Stipulations and Disputed Claims Settlement" (DCS) that is designed to resolve all issues raised or raisable between them.

Pursuant to the agreement, claimant understands that the employer's denials, as supplemented by the agreement, "shall be affirmed." The parties further agree that "all Requests for Hearing" shall be "dismissed with prejudice."

We approve the parties' settlement, thereby fully and finally resolving their dispute. Accordingly, this matter is dismissed with prejudice.

IT IS SO ORDERED.
