This matter came before a three-judge panel of the Nez Perce Tribal Court of Appeals pursuant to Respondent's October 12, 1995 Objection to the removal of Justice John Roe as Appellate Judge in this case.

This matter is an immediate appeal filed pursuant to Nez Perce Tribal Law and Order Code, § 2-4-10. Section 2-4-10 provides that "one member of the Appellate Court shall hear an immediate appeal".
