LEVINE, Justice.

Ernest Lang brought an action to evict Gordon Binstock from real property. The trial court dismissed Lang's complaint, finding that he had no present possessory right to the property as required by NDCC Sec. 33-06-01. Lang moved for reconsideration of the order dismissing his claim. The trial court denied the motion and Lang appealed.

We affirm pursuant to Rule 35.1(a)(4), North Dakota Rules of Appellate Procedure.
