Court | New York Court of Appeals Court of Appeals |
The order of the Appellate Division, 114 A.D.2d 818, 495 N.Y.S.2d 389, insofar as appealed from should be affirmed, with costs.
The arbitration award was properly confirmed inasmuch as the award was not irrational and did not violate any limitations on arbitral authority expressly contained in the lease (see, Silverman v. Benmor Coats, 61 N.Y.2d 299, 473 N.Y.S.2d 774, 461 N.E.2d 1261; cf. Avon Prods. v Solow, 54 N.Y.2d 637, 442 N.Y.S.2d 506, 425 N.E.2d 894). Additionally, we agree with the Appellate Division that the award rendered November 30, 1984 was final and definite, and, therefore, did not violate any time limitations agreed upon by the parties (see, Matter of States Mar. Lines [Crooks], 13 N.Y.2d 206, 245 N.Y.S.2d 581, 195 N.E.2d 296).
