| Decision Date | 12 May 1930 |
| Docket Number | No. 331.,331. |
| Parties | NICHOLS v. STATE. |
Appeal from Circuit Court, Newton County; J. F. Koone, Judge.
Earl Nichols was convicted of burglary, and he appeals.
Affirmed.
A. B. Arbaugh, of Jasper, for appellant.
Hal L. Norwood, Atty. Gen., for the State.
The defendant prosecutes this appeal from a judgment of conviction for burglary. The indictment is in good form. There is no bill of exceptions and no error apparent upon the face of the record. One of the grounds of the motion for a new trial is that the court erred in overruling the defendant's motion for a continuance. In the absence of a bill of exceptions, the proceedings on this branch of the case are not a part of the record which can be considered by this court. Adkisson v. State, 142 Ark. 34, 218 S. W. 167. Therefore, the judgment will be affirmed.
