John Parker was convicted of a criminal offense, and he appeals. Affirmed.

SIMPSON, J.

It appears from the record that this case was tried and the defendant convicted on the 5th day of July, 1905, and the bill of exceptions was signed on the 3d day of August, 1905. There is nothing to show when the court adjourned, nor that any time was allowed for the signing of the bill of exceptions. Hence it does not affirmatively appear that the bill of exceptions was signed within the time preseribed by law, and it cannot be considered.

There being no error apparent on the record, the judgment of the court is affirmed.
