ORDER
On order of the Court, the application for leave to appeal is considered and, in lieu of granting leave to appeal, pursuant to GCR 1963, 853.2(4), we REMAND this case, 106 Mich.App. 397, 308 N.W.2d 230, to the Court of Appeals for reconsideration in light of People v. Paintman and People v. Conklin, 412 Mich. 518, 315 N.W.2d 418 (1982). On remand the Court shall also address the merits of defendant's second issue on appeal.
We do not retain jurisdiction.
