ORDER

The Court of Appeals decision dated December 8, 1978, the Court of Appeals record, and the trial court record have been considered by the Court, pursuant to a letter request of the defendant under Administrative Order 1977-4, 400 Mich. lxvii, to determine whether leave to appeal or other relief should be granted by this Court.

Pursuant to GCR 1963, 853.2(4), we VACATE the conviction on Count IV, criminal sexual conduct in the first degree, to-wit: sexual penetration under circumstances involving the commission of another felony. People v. Willie Johnson, Jr. and People v. Richard Johnson, 406 Mich. 320, 279 N.W.2d 534 (1979). In all other respects this Court is not persuaded that relief should be granted and it is therefore DENIED.
