Appeal from Supreme Court, Appellate Division, First Department, 5 A.D.2d 809, 170 N.Y.S.2d 979.

The defendant appealed to the Appellate Division from an adverse judgment, and the Appellate Division unanimously affirmed the judgment.

The defendant appealed to the Court of Appeals and made application in the Court of Appeals to have the appeal heard on the original record and for assignment of counsel.

The Court of Appeals, 4 N.Y.2d 907, 174 N.Y.S.2d 658, granted application to have the appeal heard on the original record and for assignment of counsel and assigned David P. Siegel, New York City, as counsel for the defendant on the appeal.

The Court of Appeals, 4 N.Y.2d 1042, 177 N.Y.S.2d 696, granted motion for enlargement of time and set the case down for argument during the first fall, 1958, session of the Court of Appeals.

The Court of Appeals, 5 N.Y.2d 861, 182 N.Y.S.2d 1114, granted application for assignment of counsel and assigned Henry W. Schober, of 150 Old Country Road, Mineola, New York, as counsel for defendant.

Motion was made in the Court of Appeals for further enlargement of time.

Motion for a further enlargement of time granted and the case set down for argument during the April, 1959, session of this Court.
