On order of the Court, the delayed application for leave to appeal is considered and, pursuant to GCR 1963, 853.2(4), in lieu of granting leave to appeal, we VACATE in part the Court of Appeals judgment. Since the defendant's motion to remand identifies issues sought to be reviewed on appeal which should be initially decided by the trial judge, the Court of Appeals should have granted defendant's motion to remand to the trial court. GCR 1963, 817.6. Subsequent decision of those issues on an inadequate record was error. The matter is REMANDED to the Court of Appeals which shall, while retaining jurisdiction, remand the matter to the Monroe Circuit Court for a hearing on defendant's allegations. After such hearing, the Court of Appeals shall reconsider defendant's allegations with regard to his sentencing. In all other respects, the delayed application for leave to appeal is DENIED. We retain no jurisdiction.
