On order of the Court, plaintiff-appellant's application for leave to appeal having been ordered held in abeyance pending decision in People v. Ford, and said decision having been issued on December 23, 1982, 417 Mich. 66, 331 N.W.2d 878.
Now, therefore, the application by plaintiff-appellant for leave to appeal is considered and, pursuant to GCR 1963, 853.2(4), in lieu of granting leave to appeal, we VACATE the Court of Appeals judgment and REMAND the case to the Court of Appeals for reconsideration in light of People v. Ford, People v. Gonzales, and People v. Howard, 417 Mich. 66, 331 N.W.2d 878 (1982).
We retain no jurisdiction.
