ORDER

The Court of Appeals decision dated August 24, 1987, the Court of Appeals briefs and record, and the trial court record have been considered by the Court, pursuant to a letter request of the defendant under MCR 7.303, to determine whether leave to appeal or other relief should be granted by this Court.

On order of the Court, the letter request is treated as an application for leave to appeal and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the judgment of the Court of Appeals and REMAND this case to the Court of Appeals for reconsideration in light of People v. Allen, 429 Mich. 558, 420 N.W.2d 499 (1988). In all other respects, leave to appeal is DENIED.

We do not retain jurisdiction.
