Disposition: Leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the Court of Appeals judgment of November 17, 1995, and REMAND this case to that court for it, while retaining jurisdiction, to REMAND to the trial court for an evidentiary hearing as proposed in the dissenting opinion in the Court of Appeals. The Court of Appeals shall thereafter reconsider this issue.

We do not retain jurisdiction.
