ORDER

By order of October 9, 1985, the applications for leave to appeal were held in abeyance pending the decision in People v. Fernandez (Docket No. 76675). On order of the Court, the decision having been issued on December 29, 1986, 427 Mich. 321, 398 N.W.2d 311, the applications are again considered and, in lieu of granting leave to appeal, we REMAND this matter to the Court of Appeals for reconsideration of its decision in light of the decision to be rendered by that Court on remand in People v. Fernandez, supra. In all other respects, the defendant's application for leave to APPEAL IS DENIED. THE PLAINTIFF'S application is also considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.
