Appeal from Supreme Court, Appellate Division, Second Department, 20 A.D.2d 899, 248 N.Y.S.2d 1012.
Defendant was convicted of felony murder in the first degree, murder in the second degree, and arson in the third degree. The Supreme Court, Nassau County, Thomas P. Farley, J., entered judgment, and the defendant appealed.
The Appellate Division modified the judgment on the law by striking out the provision imposing a sentence of 40 years to life imprisonment on the second degree murder conviction and, as so modified, affirmed the judgment.
The defendant appealed to the Court of Appeals.
