The defendant was convicted of first degree murder, second degree murder and attempted first degree murder.

The Nassau County Court, Kelly, J., entered judgment, and the defendant appealed to the Court of Appeals.

The Court of Appeals, 13 N.Y.2d 1094, 246 N.Y.S.2d 410, 196 N.E.2d 65, affirmed the judgment insofar as it convicted the defendant of first degree murder and sentenced him to death, and otherwise dismissed appeal on the ground that there had been no review by the appropriate Appellate Division.

A motion was made in the Court of Appeals for an order pursuant to Section 503 of the Code of Criminal Procedure.

Motion for an order pursuant to § 503 of the Code of Criminal Procedure granted and the week commencing Monday, October 26, 1964 fixed for the execution of the death sentence.
