Citation | 454 N.Y.S.2d 976,57 N.Y.2d 729 |
Court | New York Court of Appeals Court of Appeals |
Parties | , 440 N.E.2d 1323 The PEOPLE etc., Respondent, v. Robert TAYLOR, Appellant. |
On review of submissions pursuant to Rule 500.2(b), order affirmed. 87 A.D.2d 771, 450 N.Y.S.2d 370. Whether defendant's remark constituted a request for counsel, and whether the defendant was induced into making statements by a promise of leniency or a police officer's legal advice, are questions of fact. These factual issues are beyond this Court's scope of review, inasmuch as the determination denying defendant's motion to suppress statements is supported by the record (People v. McRay, 51 N.Y.2d 594, 435 N.Y.S.2d 679, 416 N.E.2d 1015; People v. Eisenberg, 22 N.Y.2d 99, 291 N.Y.S.2d 318, 238 N.E.2d 719).
