Error to district court, Yankton county.G. C. Moody, for defendant. J. R. Gamble, Dist. Atty., for the People.

PER CURIAM.

For the reasons set forth in the opinion filed in the case of People v. Sponsler, ante, 459, and there being found no error apparent in the record herein, or in the rulings of the court below, the judgment is affirmed, and it is ordered that the proceedings herein be remitted to the district court of Yankton county to enforce the original judgment.

1. This case, filed at June Term, 1876, is now published by request, with others, in order that the Northwestern Reporter may cover all cases in volume 1, Dakota Reports.
