OPINION AND ORDER DISMISSING APPEAL

THIS MATTER came for hearing before the Puyallup Court of Appeals on September 19, 2000.In this case, the Defendant asks this Court to set aside the August 8, 2000 judgment of guilty rendered after a bench trial held on the charge of Illegal Discharge of Fireworks.The Court reviewed the notice of appeal and set the matter for hearing on September 19, 2000 sending notice of the hearing to the last known address of the appellant in accordance with the Puyallup Tribal Code.The appellant failed to appear on September 19, 2000.Appellant has chosen not to respond to or communicate with the Court of Appeals for over seven months, and has failed to file his opening brief as required by Puyallup law.Based upon this record, the Court finds that Appellant has abandoned his appeal.
