Reynold's Motion for Judgment on the Pleadings or Partial Summary Judgment as to S K Everhart, Stephen Everhart, Great Steaks Market, and John Sechrest [Doc. # 59] is DENIED, and R.J. Reynold's Motion to Strike [Doc. # 73] is MOOT.

The docket should be amended to reflect that S K Everhart's Pleading Doc. # 70 is a responsive pleading rather than a Motion to Dismiss.
