This a companion case to Bryan:: et al. v. Kansas City et al. (No. 14055) 232 S. W. 1080, decided by this court at this term, and it is agreed that our opinion in that case shall control in this; the facts and the law applying thereto being the same.

In accordance with the views expressed in the opinion filed in the last-named case, the judgment herein is affirmed.
