Action by Raymond Concrete Pile Company on behalf of itself and of those similarly situated against the Federation Bank and Trust Company, to impress a trust upon sums paid to a contractor under public improvements and deposited in the defendant's bank.From a judgment of the Appellate Division, 261 App.Div. 25, 23 N.Y.S.2d 933,262 App.Div. 847, 29 N.Y.S.2d 511, which reversed a judgment of the Special Term, 174 Misc. 206, 20 N.Y.S.2d 575, in favor of the defendant dismissing the complaint and awarding judgment for plaintiff, defendant appealed and the Court of Appeals, 288 N.Y. 452, 43 N.E.2d 486, reversed the judgment of the Appellate Division and affirmed the judgment of the Special Term, and thereafter granted a motion for reargument, 289 N.Y. 650, 44 N.E.2d 623.
