Proceedings under the Workmen's Compensation Act by Jacob Rekoon, executor of Leopoldo R. Torres, deceased, against the General Lead Batteries Company, to recover compensation for the death of deceased. Upon findings of the Bureau and of the Court of Common Pleas in favor of plaintiff, defendant applies for certiorari.
Application denied.

In examining this application for a writ of certiorari, we concur with the findings of the bureau and the court of common pleas that there was an accident arising out of and in the course of the employment. The employee suffering from tuberculosis, while lifting a heavy weight, felt a sudden strain which resulted in a hemorrhage. The reasoning in Bernstein Furniture Co. v. Kelly, 114 N.J.L. 500, 177 A. 554, affirmed 115 N.J.L. 500, 180 A. 832, is controlling.
The application will be denied.
