ORDER

On order of the Court, the motion for immediate consideration is considered, and it is GRANTED.

The application for leave to appeal, motion for immediate release of escrowed funds, and the motion to remand to the Court of Appeals without prejudice as to appellate rights are considered and, pursuant to GCR 1963, 853.2(4), in lieu of granting leave to appeal or other relief, we VACATE the Court of Appeals judgment 317 N.W.2d 238 and REMAND the case to the Court of Appeals for reconsideration in light of 1982 PA 56.

We do not retain jurisdiction.
