The petition for rehearing filed by appellant is overruled with the following modification of the filed opinion towit:

All of the first paragraph of Division IV of the opinion, except the first sentence of said paragraph is hereby deleted and there is substituted in lieu thereof the following:

'It is conceded that later instructions embodied the applicable law on that defense. The point was not raised below.'
