Pool Grinstead was convicted of libel, which conviction was reversed by the court of appeals, and case certified to the supreme court. Dismissed.

OPINION

PER CURIAM.

This is an appeal from a judgment of conviction of libel. The appeal was taken to the court of appeals, which court reversed the judgment of the district court. 61 P. 975. Upon application of the state, it was ordered to be certified to this court. We are unable to examine any of the claims of error. The case comes to us, of course, upon a transcript of the record, including bills of exception. The transcript is correctly certified, but the certificate is erroneous in its statement. The transcript is not full and complete. There is no motion for a new trial contained in it. Under the repeated rulings heretofore made, we are unable to examine the record. Neiswender v. James, 41 Kan. 463, 21 P. 573. The appeal is dismissed.
