CourtUnited States State Supreme Court of Vermont

Karen R. Carroll, Associate Justice

Defendant Neal Joseph filed this appeal on June 7, 2022, alleging that he has been held without bail in pre-trial detention for a period exceeding the sixty-day maximum allowable under 13 V.S.A. § 7553b(b). However, defendant filed a motion on May 25, 2022, requesting the criminal division to "schedule a bail-review hearing and . . . set bail for [him.]" Id. § 7553b(b). The criminal division granted the motion on the same day, but it did not schedule a hearing at that time. On June 9, 2022, the criminal division scheduled a bail-review hearing for June 13, 2022. Because that hearing has not yet occurred, defendant's appeal is premature and therefore dismissed.
