On order of the Court, the application for leave to appeal is considered and the same is hereby granted. Although the Court declines to adopt the reasoning set forth in the Court of Appeals' opinion, the Court on its own motion pursuant to GCR 1963, 865.1(7) affirms the decision of the Court of Appeals, 51 Mich.App. 253, 214 N.W.2d 907. The matter is hereby remanded to the Circuit Court for the County of Wayne for trial. See Dyke v. Richard, 390 Mich. 739, 213 N.W.2d 185 (1973).
