The appeal from the judgment in this cause presents for review the same question already decided at this term in the case of Bielenberg v. Railroad Co., 20 Pac. Rep. 314. For the same reasons assigned in the latter cause, the judgment in this case is reversed, with costs, and the cause is remanded to the court below for a new trial.
