Appeal from Supreme Court, Appellate Division, First Department, 13 A.D.2d 924, 216 N.Y.S.2d 307.
A wife brought a separation action on ground of abandonment and sought to recover alimony at the rate of $40,000 per annum.
The Supreme Court, Special and Trial Term, New York County, Isidor Wasservogel, Special Referee, 25 Misc.2d 938, 207 N.Y.S.2d 940, rendered a separation decree and awarded the wife alimony in an allegedly inadequate amount amount, and the wife appealed.
The Appellate Division, 13 A.D.2d 924, 216 N.Y.S.2d 307, affirmed the judgment and held that the amount awarded as support for the wife was adequate.
The wife appealed to the Court of appeals.
