Appeal from Supreme Court.
Action by Charles A. Wirth against L. Sigmund Gabry and another for damages to an automobile because of a collision with named defendant's automobile, and counter-claim by defendants for personal injuries and damages to the latter automobile. From a judgment, 120 N.J.L. 432, 200 A. 556, reversing a judgment for plaintiff against named defendant, plaintiff appeals.

The judgment of the Supreme Court is affirmed for the reasons stated in the deliverance of Mr. Justice Porter.
It suffices to add that the doctrine of respondeat superior rests upon the relation of master and servant. In the doing of the negligent act, the servant must be engaged in his master's affairs or business. Doran v. Thomsen, 76 N.J.L. 754, 71 A. 296, 19 L.R.A.,N.S., 335, 131 Am.St.Rep. 677; Missell v. Krause, 108 N.J.L. 350, 156 A. 461; Schank v. Cerniglia, 113 N.J.L. 306, 174 A. 730. This disposes of the point made by appellant.
