Appeals from Supreme Court, Appellate Division, First Department, 2 A.D.2d 678, 153 N.Y.S.2d 563; 2 A.D.2d 678, 154 N.Y.S.2d 422.

Landlord brought separate proceedings under the Civil Practice Act, § 1283 et seq., against the Temporary State Housing Rent Commission and against the State Rent Administrator to set aside determination fixing maximum rents and to declare an amendment to rent regulations invalid.

The Supreme Court, New York County, Special Term, Part I, Hecht, J., 3 Misc.2d 356, 153 N.Y.S.2d 851; 3 Misc.2d 1012, 155 N.Y.S.2d 264 entered orders granting application to declare amendment invalid and granting in part application to set aside determination, and the Temporary State Housing Rent Commission and the State Rent Administrator appealed.

The Appellate Division, 2 A.D.2d 678, 153 N.Y.S.2d 563; 2 A.D.2d 678, 154 N.Y.S.2d 422, affirmed the orders.

The State Housing Rent Commission and the State Rent Administrator appealed to the Court of Appeals, contending that a prior administrative grant under the six per cent net return formula has a direct inflationary influence on a subsequent sale price, and that consequently the State Rent Administrator was justified in rejecting the sale price as the index of property value.
