RULING ON DEFENDANT'S MOTION TO LIFT INJUNCTION
The year 2012 marked the fortieth anniversary of the sex discrimination statute known as Title IX. See Education Amendments of 1972, Pub.L. No. 92–318, Title IX, §§ 901–907, 86 Stat. 235, 373–375 ( ). Born of congressional concerns about “ ‘massive, persistent patterns of discrimination against women in the academic world,’ ” McCormick v. Sch. Dist. of Mamaroneck, 370 F.3d 275, 286 (2d Cir.2004) (quoting 118 CONG. REC. 5804 (1972) (statement of Sen. Bayh)), the law prohibits educational institutions that receive federal funds from engaging in sex-based discrimination in the programs and activities they sponsor, including athletics. In the two score years since its enactment, Title IX has marshaled significant change in public attitudes about, and opportunities for, women in sport.
